It's been a while. From what I remember, it seemed frivolous at the time. If it was an energy drink they were going after, it'd make more sense but there are so many brands that put Monster in their name. The fact that it is liquid beverage here makes Rock Art more of a target I suppose. I just don't think a future defendant could argue that they didn't go after Rock Art for Vermonster because it's a different-enough name and they sell to different/non-competing consumers.

I don't want to defend mega-corp Hansen, but do understand that they must monitor use - or suspected use - of their mark. Vermonster probably never really threatened Hansen's trademark, but Hansen wasn't completely wrong in flexing its muscle a little. I explain more here: http://www.galvanilegal.com/blog/vermonster-v-monster/

[...] Rock Art Brewery was sent a cease-and-desist notice from representatives of Hansen Beverage, makers of Monster Energy Drink. Its Vermonster beer would have to be renamed to something else because the name allegedly resembled that of Monster Energy Drink. Rather than lay down to the corporate behemoth, the company fought back using a viral social media campaign as its main weapon. Hansen and Rock Art would later reach an agreement and Vermonster is here to stay. [...]
